In this agreement, "you" refers to any individual who uses and accesses this website.

2 Purpose of the Agreement

This User Agreement and other service terms, rules, tips, or regulations that HUAWEI publishes for this website (hereafter collectively referred to as the "Agreement") are the conditions under which we provide you with access to and use of this website. This Agreement is intended to help you understand HUAWEI, how HUAWEI provides to you this website, the activities permitted and prohibited on this website, measures to cope with problems, and other relevant information. 4 Visiting This Website

This website is an after-sales service website provided by HUAWEI for commercial customers in China, including product rights inquiry and other services. HUAWEI shall abide by the local laws and regulations while providing services.

You understand and agree that the content of this service is provided to you by HUAWEI "as is" and "as available". HUAWEI reserves the right to decide the form and content of this service, and to alter, suspend or terminate part or all of the service at its discretion.

5 Network Service Description

To access or use this website, you shall provide on your own the networking equipment, and bear all the associated costs, including but not limited to network access fees, mobile phone data fees, etc. HUAWEI reserves the right to alter, amend, or suspend this service to the extent permitted by law for any reason, including its own business decisions and website maintenance. You fully acknowledge such rights of this website and will not make any claims against HUAWEI for this.

6 Rules of Use

You agree and undertake to access and use this service in a legal and ethical manner in accordance with this Agreement.

You shall not use this service to transmit any content with the following properties, or participate in or conduct any activity with the following properties through other means:

a) Upload, download, store, copy, publish, transmit, email or otherwise the following content prohibited by the laws, regulations and policies:

           i. Oppose the basic principles established by the Constitution;

           ii. Endanger national security, leak state secrets, subvert state power, and undermine national unity;

           iii. Harm the state’s honor and national interests;

           iv. Incite ethnic hatred, ethnic discrimination, and undermining ethnic unity;

           v. Undermine national religious policies and promote cults and feudal superstitions;

           vi. Spread rumors, disrupt social order, and undermine social stability;

           vii. Spread obscenity, pornography, gambling, violence, homicide, terror or instigate crime;

           viii. Insult or slander others, and violate the legal rights of others;

           ix. Endanger social morality or national excellent cultural traditions;

           x. Infringement of any third party's patent, copyright, trademark, reputation right or any other legal rights;

           xi. Information containing content prohibited by laws and administrative regulations.

b) Violate others’ privacy, trade secrets, trademark rights, copyrights, patent rights and other legal rights;

c) Engage in any illegal transactions, such as the sale of guns, drugs, prohibited drugs or other prohibited items;

d) Plan or implement illegal activities such as money laundering and cashing out;

e) Delete any copyright, trademark or other proprietary notices contained in this service;

f) Copy or change all or part of the content of this service, or allow this service or any part of it to be combined with any other program or integrated into any other program;

g) Unauthorized access or attempt to access or damage any part of this service or related systems or networks;

h) Decompose, decode or reverse develop the service or any part thereof, or produce derivative works based on the service or any part thereof, or attempt to engage in similar activities prohibited by applicable laws;

l) For illegal purposes, use this service (or any part of it) in any illegal manner or in a manner that violates this agreement, or perform any fraudulent or other malicious activities , including but not limited to hacking into this service (or this service link URL) or any operating system or implanting malicious code, including viruses or harmful data;

m) Infringement of the intellectual property rights of HUAWEI or any third party when accessing and/or using this service;

n) Collect information about users of this service, or use automated means to access this service or HUAWEI's system, or attempt to upload to or extract any content from the server of this service by decoding;

o) Develop, support, or use software, equipment, scripts, or any other means or processes (including crawler software, browser plug-ins, or any other technological or human operation) to grab the service or copy user information and other data from the service in other ways;

p) Use this service for commercial purposes without HUAWEI's prior written permission;

q) Use this service to engage in any illegal business activities, such as the sale of arms, drugs, illegal items, pirated software, or other contraband;

r) Provide gambling information or use any means to induce others to gamble;

s) Ask for another person's login information or access another person's account;

t) Participate in money laundering, cash-out, or pyramid schemes;

u) Violate this agreement (or any part of it), or facilitate or encourage such behavior; or

v) Damage, disable, weaken or endanger the service, HUAWEI system or its security, or overload it, interfere with other users or any other party’s computer system, invade or access to the service or HUAWEI Content (see below for definition) or data without authorization.

w) Other violations of national laws, regulations, rules, and policies, or other violations of this agreement.

7 HUAWEI Content

Unless otherwise stipulated by laws and regulations or otherwise agreed upon between HUAWEI and you, HUAWEI and/or HUAWEI’s upstream licensors reserve the rights to all information obtained under or through this service, including texts, videos, audios, pictures, icons, applications, designs, software, scripts, programs, copyrights, trademarks, trade names, logos, and other materials and services, as well as the appearance and experience of the foregoing content (hereafter collectively referred to as "HUAWEI Content"). Unless otherwise stipulated in this agreement, your access to and/or use of the service does not constitute a transfer of any ownership of the service or its content.

You shall not alter, copy, extract, amend, or add HUAWEI Content in any way, and you shall not sell, copy, distribute, permit or abuse HUAWEI Content. If you need to republish, extract, copy, distribute, or use any HUAWEI Content in other ways, you shall contact HUAWEI in advance and obtain HUAWEI's prior written permission, except in the circumstances expressly stated in this agreement. This does not prejudice any of your rights under applicable mandatory laws.

The use of this service may be interrupted, delayed, or interfered with at an unknown time due to uncontrollable reasons. You agree that HUAWEI is not liable for any claims caused by the foregoing interruption, delay, interference, or similar failures.

To the fullest extent permitted by applicable laws, HUAWEI shall not be liable for any damages caused by you or anyone else being unable to access or use the service due to the following reasons:

a) HUAWEI's maintenance or upgrade of the system or software and hardware causes the suspension or termination of this service;

b) System or network communication that is not owned or controlled by HUAWEI has delays or malfunctions;

c) The contract or other agreement between HUAWEI and any third-party payment service provider is suspended, cancelled or terminated;

d) Error or interruption due to hacking or similar security impact; or

e) Other reasons beyond HUAWEI's reasonable control.

This service is provided "as is" and "as available", with no guarantees or endorsements. To the fullest extent permitted by applicable laws, HUAWEI has not acknowledged any of the expressly stated or implied guarantees, conditions, or other agreements listed below, nor has it made any guarantees, undertakings, declarations, or guarantees in respect of:

a) The completeness, accuracy, reliability, or promptness of any content obtained under or through this service;

b) Whether the service or the server hosting the service contains defects, errors, viruses, bugs, or other harmful elements;

c) Whether the defects in the operation or functionality of this service will be corrected;

d) Guarantees related to specific functions of this service, or whether any information obtained when using or accessing this service is reliable, high-quality, or accurate;

e) Whether this service is safe and correct;

11 Compensation

To the fullest extent permitted by applicable laws in your jurisdiction, you shall hold HUAWEI harmless from any claims, litigation, or prosecution arising from or connected to the following:

1) Your content;

2) Your use of this service;

3) Your violation of any part of this agreement or the applicable end user license agreement;

4) Your infringement of a third party’s intellectual property rights or other rights;

5) Anyone who uses your HUAWEI ID to perform similar actions or violate the conditions set forth above.

Including any liabilities, damages, expenses, litigation costs, and attorney fees caused by various disputes, complaints and lawsuits arising from the above circumstances. You undertake and agree to promptly and fully assist in the defense when any HUAWEI party makes a reasonable request.

12 Termination and Change

We may suspend, restrict, cancel or terminate your access to all or part of the service in accordance with applicable law without any liability to any person or third party. We will endeavor to notify you before taking such action. However, we may immediately suspend, restrict, cancel or terminate your access to all or part of the service without prior notice to you under the following circumstances:

a) You have violated or HUAWEI has reason to believe that you are about to violate this Agreement, including any agreement, policy or guideline contained therein;

b) You or anyone acting on your behalf engages in fraudulent or illegal activities, or provides false or misleading information to HUAWEI;

c) Respond to requests from law enforcement or government departments in accordance with valid legal process;

d) To perform urgent system or hardware maintenance or update work; or

e) For unforeseen technical, security or business reasons.

The expiry or termination of this Agreement shall not affect the conditions expressly stated in this Agreement that are operable or shall survive its expiry or termination, nor shall it affect any accrued rights or obligations or any conditions which shall survive the expiry or termination of this Agreement rights or obligations.

Any terms of this agreement that are expressly or by their nature ought to survive termination will remain in full force and effect after termination of this Agreement until the conditions of those terms are satisfied or by their nature should expire.

13 Amendments To This Agreement

HUAWEI is always updating, revising and improving this service. HUAWEI may add or delete functions or performance of this service, set new restrictions, or temporarily suspend or permanently suspend the provision of a service; HUAWEI may also revise this agreement at any time based on the update of this service.

Once the updated terms of the agreement are published, it will replace the original terms of the agreement, and we will post changes to this agreement on the page in a timely manner. If you do not accept the revised agreement, please stop using this service immediately, and your continued access or use of this service is deemed to accept the revised agreement.

If amendments to this Agreement materially affect you or materially limit your access to or use of the service, we will notify you within a reasonable time prior to the change. We may not be able to meet the aforementioned notice period requirements for changes to the service to meet security, legal or regulatory requirements, but we will notify you as soon as possible.

14 Applicable Law and Jurisdiction

This Agreement shall be construed and governed by the laws of Italy. You agree that the courts with jurisdiction in Italy have the relevant jurisdiction.

15 General Terms

The service or third parties may provide links to other websites or resources. You understand and agree that we are not responsible for the availability of such external sites or resources, and do not endorse or assume any responsibility for any content, advertising, products or other information on or available from such sites or resources . We shall not be liable for any damages or losses caused or alleged to be caused by or in connection with your use of or reliance on any content, goods or services available on or through such sites or resources.

Nothing in this Agreement shall be deemed to establish any cooperation or agency relationship between you and HUAWEI. Neither party shall be entitled to incur any liabilities, debt or costs, or to enter into any contract or other agreement, in the name of or on behalf of the other party.

HUAWEI shall not be liable for any failure or delay of HUAWEI in performing its obligations under this Agreement or these conditions of service due to events beyond HUAWEI's reasonable control.

Branches and subsidiaries of HUAWEI are third-party beneficiaries of this agreement, and they can enforce this agreement as parties to this agreement. HUAWEI has the right to assign, subcontract or replace HUAWEI's rights and obligations under this Agreement without derogating from your rights and interests.

If any provision of this Agreement is deemed invalid, void or unenforceable by a court of competent jurisdiction or any other competent authority, such provision shall be deemed to have been deleted from this Agreement, but any other provision shall remain in force.
